1. Acceptance of these Terms

By accessing, browsing, registering for, uploading to, or otherwise using vchan (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

The Service is an adult-oriented video community that may include user-generated content, curated catalogs, channels, comments, and related features. The Service is intended only for adults.

2. Eligibility and age restriction

You must be at least eighteen (18) years of age, or the age of majority in your jurisdiction if higher, to access or use the Service. By using the Service you represent and warrant that you meet this requirement and that you are not accessing the Service from a jurisdiction where adult content is unlawful.

We may request age assurance or identity verification at any time. Failure to complete verification may result in suspension or termination of access.

3. Accounts and security

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly at [email protected] if you suspect unauthorized use.

You agree to provide accurate registration information and to keep it current. We may refuse, suspend, or terminate accounts that violate these Terms or applicable law.

4. Adult content; no minors

All sexual content on the Service must depict only consenting adults who were eighteen (18) years of age or older at the time of creation. Content involving anyone under eighteen (18), or that appears to depict a minor, is strictly prohibited and will be removed. Related accounts may be terminated and reports may be made to law enforcement.

Uploaders must retain and, where required by law, make available records demonstrating that all depicted performers were adults at the time of production. See our 18 U.S.C. § 2257 statement and Uploader Agreement.

5. License to use the Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial viewing, and — if authorized — to upload and manage content through your channels.

You may not scrape, bulk-download, reverse engineer, circumvent technical controls, interfere with the Service, or use automated means to access the Service without our prior written consent.

6. User content and channels

Channels and uploads remain associated with the uploading account subject to moderation, review, locking, and removal rights described in these Terms and our Community Guidelines.

By uploading or submitting content, you grant vchan a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, transcode, display, distribute, and promote that content in connection with operating and improving the Service. This license ends when your content is permanently deleted from our systems, except for reasonable residual copies in backups or caches and except where retention is required by law.

You retain ownership of your content to the extent you own it. You are solely responsible for the content you upload and for obtaining all rights, consents, and releases needed to publish it.

7. Prohibited content and conduct

You may not upload, share, or solicit content or conduct that violates our Community Guidelines or applicable law, including without limitation:

• Any sexual or pornographic content involving minors (persons under 18), whether real or fictionalized in a way that depicts minors
• Non-consensual intimate imagery, revenge porn, hidden-camera content, or content obtained without required consent
• Content that infringes copyright, trademark, or other intellectual-property rights
• Doxxing, threats, harassment, hate speech targeting protected characteristics, or incitement to violence
• Malware, phishing, spam, fraud, or deceptive impersonation
• Illegal goods or services, or content that facilitates trafficking or exploitation

8. Moderation and enforcement

We may review, refuse, remove, shadow-ban, lock, demonetize, or restrict content or accounts at our discretion, including for legal, safety, or community reasons. We are not obligated to monitor all content, but we reserve the right to do so.

Repeated or severe violations may result in permanent bans. Decisions may be revisited if new information becomes available.

9. Copyright complaints

If you believe content on the Service infringes your copyright, follow the process described in our DMCA / Copyright Policy. Repeat infringers may have their accounts terminated.

10. Payments and virtual benefits

If we offer paid memberships, tips, unlocks, or other paid features (including via cryptocurrency), additional purchase terms may apply at checkout. Fees are generally non-refundable except where required by law.

Access to paid features may be suspended if payment fails, chargebacks occur, or your account is terminated for violation of these Terms.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that content will meet your expectations.

User-generated content reflects the views of its uploaders, not necessarily those of vchan.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, vchan AND ITS OPERATORS, AFFILIATES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

Our aggregate liability for claims relating to the Service shall not exceed the greater of (a) the amounts you paid to us in the three (3) months preceding the claim, or (b) fifty U.S. dollars (US $50).

13. Indemnification

You agree to defend, indemnify, and hold harmless vchan and its operators from and against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your content, your use of the Service, or your violation of these Terms or applicable law.

14. Termination

You may stop using the Service at any time. We may suspend or terminate access immediately for any breach of these Terms or for operational, legal, or security reasons. Provisions that by their nature should survive termination will survive.

15. Changes

We may update these Terms from time to time. The "Last updated" date will change when we do. Continued use after changes become effective constitutes acceptance of the revised Terms. Material changes may also be highlighted in the Service or by email where appropriate.
